PHOENIX (AP) — All charges have been dropped against a Phoenix-area high school teacher accused of raping a special-education student.
Maricopa County Superior Court Judge Paul McMurdie dismissed charges of kidnapping, sexual abuse and sexual conduct with a minor against Brian Willner, a 36-year-old teacher at Avondale's Agua Fria Union High School
The Maricopa County Attorney's Office says information uncovered during an investigation caused the office to drop the case.
Willner was arrested May 3 at his Litchfield Park home after a 15-year-old student accused him of raping her in his office some time between March 23 and April 2.
A medical examination showed evidence of rape, and Avondale police said Willner and the girl tested positive for the same sexually transmitted disease.
But Willner's attorney, Richard Lougee, says the first STD test was a false-positive, and that both Willner and his wife of eight years tested negative for the disease.
