Marana awaiting decision on water lawsuit
08:17 PM MST on Thursday, June 5, 2008
The town of Marana is awaiting a ruling by Maricopa County Judge Kristin Hoffman regarding a lawsuit the town filed against Pima County over wastewater management. Hoffman heard arguments in the case on May 29 and has 60 days to rule on the suit.
In July of 2007 the town exercised it’s option to end a 1979 Intergovernmental Agreement with Pima County, allowing Marana to claim and operate the wastewater lines within the town and provide reclaimed water to it’s residents. The lawsuit is the result of a dispute between Marana and Pima County over who has rights to the water and who should operate he wastewater treatment facilities.
“The agreement was simple and requires a simple solution,” said Marana Town Attorney Frank Cassidy. “Marana’s ownership of the wastewater system allows us to provide our residents with 100% beneficial use of clean, reclaimed water. We are confident that Judge Hoffman will rule in our favor allowing Marana to have control of this valuable resource.”
