Judge rules for Marana in wastewater suit
08:45 PM MST on Wednesday, June 11, 2008
A judge has ruled in favor of the town of Marana in it’s lawsuit against Pima County over ownership of the town’s wastewater system. The town and the county have been battling over the rights since Marana exercised it’s right to end a 1979 Intergovernmental Agreement (IGA) in July of 2007. The ruling was handed down by Maricopa County Judge Kristin Hoffman.
“Today’s judgement proves that the 1979 IGA clearly and simply granted Marana rights to the wastewater system upon it’s termination,” said Marana Town Manager Mike Reuwsaat. “Marana’s ownership of the wastewater system allows us to provide our residents with 100% beneficial use of reclaimed water.”
The town now plans to work with the county on transition details to implement the court’s ruling.
